The Legal and Human Rights Committee Formed by the National Council for Civil Liberties and Human Rights Reviews the Final Amendments to the Draft Law on Persons with Disabilities

عقدت اللجنة المكلّفة بإعداد مسودة قانون الأشخاص ذوي الإعاقة، والمشكلة بموجب قرار المكلّف بتسيير مهام المجلس رقم (01) لسنة 2025، اجتماعها الدوري برئاسة الدكتورة إبتسام بحيح رئيس اللجنة، وبحضور السادة أعضاء اللجنة.
استُهِلّ الاجتماع بمراجعة شاملة لمحتوى المسودة، وتركّزت النقاشات حول وضع اللمسات الأخيرة على مشروع القانون، بما ينسجم مع المعايير الدولية لحقوق الإنسان، وبخاصة اتفاقية حقوق الأشخاص ذوي الإعاقة والمعايير ذات الصلة بالتشريعات الوطنية الضامنة لحقوقهم ، كما تناول الاجتماع التدقيق القانوني لصياغات المواد، وضمان اتساقها مع مبادئ عدم التمييز، والمساواة، والدمج، وإتاحة الوصول.
كما ناقشت اللجنة خطة العمل للمرحلة اللاحقة التي ستعقب تسليم المسودة إلى السلطة التشريعية، بما في ذلك وضع تصور لبرنامج مناصرة وتوعية مجتمعية يهدف إلى دعم مشروع القانون، عبر تنظيم لقاءات تشاورية وجلسات استماع وحوارات مع أصحاب المصلحة، لا سيما منظمات الأشخاص ذوي الإعاقة والمكونات الحقوقية والمجتمعية ذات العلاقة.
وتؤكد اللجنة التزامها بضمان أن تكون المسودة النهائية للقانون معبّرة عن مبادئ الحقوق والكرامة الإنسانية، ومحافظة على التوافق مع الالتزامات الدولية للدولة، ومرتكزة على نهج حقوقي تشاركي يعزز تمتع الأشخاص ذوي الإعاقة بجميع حقوقهم دون تمييز .

The committee tasked with preparing the draft Law on Persons with Disabilities, established pursuant to Resolution No. (01) of 2025 issued by the Acting Head of the National Council for Civil Liberties and Human Rights, held its regular meeting under the chairmanship of Dr. Ibtisam Buhaih, Chair of the Committee, with the attendance of committee members.
The meeting commenced with a comprehensive review of the draft law, with discussions focusing on finalizing the provisions of the legislation in a manner consistent with international human rights standards, particularly the Convention on the Rights of Persons with Disabilities and relevant standards governing national legislation that guarantees and protects their rights.
The meeting also addressed the legal review of the wording of the articles and ensuring their consistency with the principles of non-discrimination, equality, inclusion, and accessibility.
In addition, the committee discussed the work plan for the next phase following the submission of the draft law to the legislative authority, including the development of a public advocacy and awareness program aimed at supporting the draft legislation through consultative meetings, public hearings, and dialogue sessions with stakeholders, particularly organizations of persons with disabilities, as well as relevant human rights and civil society actors.
The committee reaffirmed its commitment to ensuring that the final draft of the law reflects the principles of human rights and human dignity, remains consistent with the State’s international obligations, and is founded on a participatory rights-based approach that promotes the full enjoyment of rights by persons with disabilities without discrimination.
