وجّه المجلس الوطني للحريات وحقوق الإنسان مذكرة رسمية إلى رئاسة مجلس إدارة الشركة العامة للكهرباء، تناولت الالتزامات الحقوقية المترتبة على ضمان استمرارية توفير خدمة الكهرباء، باعتبارها إحدى الخدمات العامة الأساسية المرتبطة ارتباطًا وثيقًا بجملة من الحقوق المكفولة دستوريًا ودوليًا، وفي مقدمتها الحق في الحياة، والصحة، والمياه، والتعليم، والعمل، والعيش الكريم.
وأكد المجلس أن توفير الكهرباء لا يُعد مجرد التزام خدمي أو إداري، وإنما يمثل واجبًا قانونيًا وحقوقيًا يقع على عاتق الدولة ومؤسساتها، وفقًا لأحكام التشريعات الوطنية والاتفاقيات الدولية ذات الصلة بحقوق الإنسان، بما يضمن استمرارية الخدمات الأساسية ويحافظ على كرامة الإنسان.
وأشار المجلس إلى أن استمرار الانقطاعات المتكررة للتيار الكهربائي ينعكس بصورة مباشرة على تمتع المواطنين بحقوقهم الأساسية، ويؤثر في أداء المرافق الحيوية، ولا سيما المؤسسات الصحية والتعليمية والخدمية، فضلًا عن تداعياته الاجتماعية والاقتصادية والإنسانية، الأمر الذي يستوجب اتخاذ تدابير عاجلة وفعّالة لمعالجة أسباب الأزمة والحد من آثارها.
ودعا المجلس إلى تبني مقاربة حقوقية في إدارة قطاع الكهرباء، تقوم على مبادئ المساواة وعدم التمييز، والشفافية، والمساءلة، وإعطاء الأولوية لحماية الفئات الأكثر احتياجًا، بما يكفل استدامة الخدمة ويعزز ثقة المواطنين في مؤسسات الدولة.
كما أكد المجلس استعداده للتعاون مع الجهات المختصة في كل ما من شأنه دعم الجهود الرامية إلى تحسين الخدمات العامة، انطلاقًا من ولايته الوطنية في تعزيز وحماية حقوق الإنسان، وبما يسهم في ضمان احترام الحقوق الأساسية وصون كرامة الإنسان.

The National Council for Public Liberties and Human Rights has addressed an official memorandum to the Chairperson of the Board of Directors of the General Electricity Company, outlining the human rights obligations associated with ensuring the uninterrupted provision of electricity services. The memorandum emphasizes that electricity is an essential public service intrinsically linked to a range of rights guaranteed under national legislation and international human rights instruments, foremost among them the rights to life, health, water, education, work, and an adequate standard of living.
The Council affirmed that the provision of electricity should not be regarded merely as a service delivery or administrative responsibility, but rather as a legal and human rights obligation incumbent upon the State and its institutions, in accordance with national laws and relevant international human rights standards. This obligation requires ensuring the continuity of essential public services while safeguarding human dignity.
The Council further noted that recurring power outages have a direct impact on the enjoyment of fundamental human rights, adversely affecting the functioning of vital public facilities, particularly healthcare, educational, and other essential service institutions. It also highlighted the broader social, economic, and humanitarian consequences of these disruptions, stressing the need for urgent and effective measures to address the underlying causes of the electricity crisis and mitigate its impacts.
The Council called for the adoption of a human rights-based approach to the governance of the electricity sector, founded on the principles of equality and non-discrimination, transparency, accountability, and prioritizing the protection of the most vulnerable groups. Such an approach, the Council emphasized, would contribute to the sustainability of electricity services and strengthen public confidence in State institutions.
The Council also reaffirmed its readiness to cooperate with the competent authorities in supporting efforts aimed at improving public services, in line with its national mandate to promote and protect human rights, and in a manner that ensures respect for fundamental rights and the preservation of human dignity.
