عقد المكلف بتسيير أعمال المجلس الوطني للحريات وحقوق الإنسان، الأستاذ عبدالمولى رمضان أبونتيشة، أمس الثلاثاء، لقاءً تقابلياً مع معالي وزير الصحة الدكتور محمد الغوج، بحضور وكيل وزارة الصحة لشؤون المستشفيات العامة الدكتور سعدالدين عبد الوكيل، وذلك في إطار تعزيز التعاون المؤسسي بين المجلس والوزارة، ودعم الجهود الوطنية الرامية إلى تعزيز وحماية حقوق الإنسان، وفي مقدمتها الحق في التمتع بأعلى مستوى ممكن من الصحة.
وفي مستهل اللقاء، قدم الأستاذ عبدالمولى أبونتيشة إحاطة تعريفية حول الاختصاصات القانونية للمجلس الوطني للحريات وحقوق الإنسان، باعتباره المؤسسة الوطنية المعنية بتعزيز وحماية حقوق الإنسان وفقاً للتشريعات الوطنية والمبادئ الدولية الناظمة لعمل المؤسسات الوطنية لحقوق الإنسان، مستعرضاً دوره في الرصد والمتابعة وإعداد التقارير وتقديم التوصيات إلى الجهات المختصة، بما يسهم في تطوير السياسات العامة وتعزيز امتثال المؤسسات الوطنية لمعايير حقوق الإنسان.
كما استعرض نتائج الزيارات الميدانية التي نفذها المجلس إلى عدد من مؤسسات الإصلاح والتأهيل، والتي كشفت عن جملة من التحديات المتعلقة بالحق في الرعاية الصحية للنزلاء، تمثلت في محدودية برامج الرعاية الصحية، ووجود حالات تعاني من أمراض مزمنة تتطلب متابعة طبية منتظمة، إلى جانب النقص في بعض الأدوية والعلاجات الأساسية، فضلاً عن الحاجة إلى تعزيز آليات التنسيق بين مؤسسات الإصلاح والتأهيل والمؤسسات الصحية الحكومية بما يضمن سرعة الإحالة الطبية، واستمرارية العلاج، وتقديم الخدمات الصحية وفقاً للاحتياجات الطبية لكل نزيل، وبما ينسجم مع المعايير الوطنية والدولية ذات الصلة بمعاملة الأشخاص المحرومين من حريتهم.
وأكد المكلف بتسيير أعمال المجلس أن ضمان الرعاية الصحية داخل أماكن الاحتجاز يمثل أحد الالتزامات الأساسية الواقعة على عاتق الدولة، ويعد جزءاً أصيلاً من حماية الكرامة الإنسانية وصون الحقوق الأساسية المكفولة بموجب التشريعات الوطنية والاتفاقيات الدولية ذات الصلة.
من جانبه، أشاد وزير الصحة بالدور الوطني والإنساني الذي يضطلع به المجلس الوطني للحريات وحقوق الإنسان في متابعة أوضاع حقوق الإنسان ورصد التحديات القائمة، مؤكداً استعداد وزارة الصحة وجميع مؤسساتها ومرافقها الصحية لتقديم أوجه الدعم والتعاون مع المجلس، بما يسهم في تعزيز الحق في الصحة، والارتقاء بجودة الخدمات الصحية، وترسيخ مبادئ العدالة والكرامة الإنسانية.
واختتم اللقاء بالاتفاق على تشكيل لجنة فنية مشتركة بين المجلس الوطني للحريات وحقوق الإنسان ووزارة الصحة، تتولى إعداد برنامج متكامل للتعاون المشترك، يتضمن حزمة من المبادرات والأنشطة التنفيذية الرامية إلى تعزيز الحق في الصحة، وفي مقدمتها تطوير الخدمات الصحية المقدمة لنزلاء مؤسسات الإصلاح والتأهيل، وذلك بالتنسيق مع وزارة العدل وجهاز الشرطة القضائية، وبما يحقق التكامل المؤسسي ويرفع من مستوى الامتثال للمعايير الوطنية والدولية في مجال الرعاية الصحية داخل أماكن الاحتجاز .

The Acting Head of the National Council for Civil Liberties and Human Rights, Mr. Abdulmoli Ramadan Abuntisha, held a bilateral meeting on Tuesday with the Minister of Health, Dr. Mohammed Al-Ghouj, in the presence of the Undersecretary of the Ministry of Health for Public Hospitals, Dr. Saadeddin Abdulwakil. The meeting was held within the framework of strengthening institutional cooperation between the Council and the Ministry and supporting national efforts aimed at promoting and protecting human rights, foremost among them the right of everyone to the enjoyment of the highest attainable standard of health.
At the outset of the meeting, Mr. Abdulmoli Abuntisha provided an overview of the legal mandate of the National Council for Civil Liberties and Human Rights as the national institution responsible for the promotion and protection of human rights in accordance with national legislation and the international principles governing the work of National Human Rights Institutions. He highlighted the Council’s role in monitoring and documenting human rights conditions, preparing reports, and submitting recommendations to the competent authorities, thereby contributing to the development of public policies and strengthening the compliance of national institutions with human rights standards.
He also presented the findings of the Council’s field visits to a number of correctional and rehabilitation institutions, which revealed several challenges relating to the right of inmates to healthcare. These included limited healthcare programmes, the presence of inmates suffering from chronic illnesses requiring regular medical follow-up, shortages of certain essential medicines and treatments, and the need to strengthen coordination mechanisms between correctional and rehabilitation institutions and public healthcare facilities to ensure timely medical referrals, continuity of treatment, and the provision of healthcare services tailored to the medical needs of each inmate, in line with the relevant national and international standards governing the treatment of persons deprived of their liberty.
The Acting Head of the Council emphasized that ensuring access to healthcare in places of detention constitutes one of the State’s fundamental obligations and forms an integral part of safeguarding human dignity and protecting the fundamental rights guaranteed under national legislation and the relevant international human rights instruments.
For his part, the Minister of Health commended the National Council for Civil Liberties and Human Rights for its important national and humanitarian role in monitoring the human rights situation and identifying existing challenges. He affirmed the Ministry of Health’s readiness, together with all its institutions and healthcare facilities, to provide full support and cooperation with the Council in order to strengthen the right to health, improve the quality of healthcare services, and promote the principles of justice and human dignity.
The meeting concluded with an agreement to establish a Joint Technical Committee between the National Council for Civil Liberties and Human Rights and the Ministry of Health. The Committee will be tasked with developing a comprehensive programme of joint cooperation encompassing a package of practical initiatives and implementation activities aimed at strengthening the right to health, with particular emphasis on improving healthcare services provided to inmates in correctional and rehabilitation institutions. This will be undertaken in coordination with the Ministry of Justice and the Judicial Police Authority, with a view to enhancing institutional coordination and increasing compliance with national and international standards governing healthcare in places of detention.
