🔹بمناسبة اليوم العالمي لمكافحة تجنيد الأطفال في النزاعات المسلحة الذي يصادف تاريخه الثاني عشر من فبراير من كل عام، و في إطار إطلاع المجلس الوطني للحريات وحقوق الإنسان بدوره الحقوقي، نظم صباح اليوم الأربعاء بفندق المهاري بطرابلس مائدة مستديرة بعنوان (اشتراك وتجنيد الأطفال في النزاعات المسلحة ) . ..
🔹وترأس جلسات المائدة مستشار رئيس المجلس الأستاذ “عبدالباري شنبارو”، ومدير إدارة متابعة أوضاع المرأة الأستاذة “فاطمة حواص”، وحضر أعمالها كل من الأستاذ “فهمي التواتي ” عضو لجنة حقوق الإنسان بمجلس النواب الليبي، والأستاذ “نوري الوحيشي” ممثل عن الادعاء العسكري ومسؤولة ملف حقوق الطفل بمكتب حقوق الانسان بالبعثة الأمم المتحدة للدعم في ليبيا الأستاذة “مريم جعفر”، والأستاذة “تاهمينة جنغوريان” عن اللجنة الدولية للصليب الأحمر، والأستاذ “عمر العسكري” عن المنظمة الدولية للهجرة، وممثل عن مكتب الأمم المتحدة الإنمائي، والدكتور “وسام عمر المجدوب” ممثل عن مكتب حقوق الإنسان بوزارة الداخلية، والأستاذة “مفيدة الفطيسي” ممثلة عن مكتب حقوق الانسان والقانون الدولي الإنساني بوزارة الدفاع، والاستاذة “نعيمة المقوب” عن للجنة العليا للطفولة، ومنسق القانون الدولي الإنساني بجمعية الهلال الأحمر الليبي الدكتور “على عبدالجبار”، والمستشار الاكاديمي الأستاذ “عبد السيد العيساوي”, وعن الجمعية الليبية لأعضاء الهيئات القضائية الدكتور “حيدر العائب” والأستاذ “احميد الزيداني”، وعن مركز القانون الدولي الإنساني الأستاذ “خطاب خالد”, ورئيس قسم الاجتماع بكلية الآداب بجامعة طرابلس الدكتورة “حورية درهوبي”، كما شارك العديد من ممثلي مؤسسات المجتمع المدني الحقوقية والعاملة في مجالات حقوق الطفل , والاعلام .
🔹المجلس وفي كلمة الافتتاح أكد انه يُولي أهمية كبيرة لموضوع تجنيد الأطفال اثناء النزاعات المسلحة باعتباره انتهاك لحقوق الإنسان والقانون الدولي الإنساني، مطالب الأطراف المعنية من مؤسسات رسمية ومنظمات دولية ومجتمع مدني، بتحمل مسؤولياتهم في حماية الأطفال، من الاستغلال أثناء النزاعات المسلحة، والعمل على اتخاذ كافة التدابير لحماية هذه الفئات من كافة السلطات التشريعية والقضائية والتنفيذية بالدولة، ووضع تشريعات وسياسات واتخاذ إجراءات صارمة لحماية هذه الفئات العمرية لضمان عدم تجنيدهم, كما طالب المجلس بزيادة وتعزيز الوعى العام بهذه القضية الإنسانية الحقوقية، من خلال وضعها ضمن أولويات و أجندات مؤسسات الدولة الوطنية .
🔹وتضمنت أجندة المائدة المستديرة عدداً من المحاور الهامة أبرزها :
موقف القانون الدولي لحقوق الانسان من تجنيد الأطفال، واشراكهم في النزاعات المسلحة, وقراءات أخرى في الأبعاد الإنسانية للقانون الدولي الإنساني لمكافحة تجنيد الأطفال، ومشاركتهم في النزاعات المسلحة, والتكييف القانوني لظاهرة تجنيد الأطفال في النزاعات المسلحة, وتجنيد الأطفال في النزاعات المُسلحة في ضوء الشريعة الإسلامية والقانون الدولي الإنساني وتجنيد الأطفال وإشكالية السن في التشريعات الليبية, وتبادل الآراء حول مدى موائمة التشريعات المحلية مع الاتفاقيات الدولية، وكذلك مناقشة موائمة التشريعات المحلية فيما بينها، مثلا في تحديد سن الطفولة فيما بين القانون المدني وقانون حماية الطفولة والقانون العسكري وقانون العقوبات، وتم تبادل الآراء والمداخلات بين الحضور حول ذلك . ..
🔹وجرت مناقشات مستفيضة حول محاور المادة، وعبر المشاركين خلال مداخلتهم عن تقديرهم وامتنانهم لجهود وعمل المجلس الوطني للحريات وحقوق الانسان المتميز في مجال إدارة قضايا حقوق الانسان، والتي منّ أهمّها الـتوعية الحقوقية ورصد الانتهاكات واستقبال الشكاوى، وحماية ضحايا الانتهاكات، وتقديم الرؤى والمقترحات خاصة ما يتعلق بتطوير التشريعات الوطنية لتتماشى مع منظومة حقوق الإنسان الدولية .
🔹وفي ختام أعمال المائدة المستديرة تم الخروج بحملة من التوصيات المهمة، التي أكدت على أهمية الالتزام الوطني بتطبيق قواعد القانون الدولي الإنساني ومنظومة حقوق الإنسان الدولية وخاصة، ما جاءت به الاتفاقية الدولية لحماية حقوق الطفل، كما أكد المشاركون على ضرورة متابعة تنفيذ ما ورد من توصيات كلا بحسب اختصاصه المؤسساتي، للحد من تجنيد الأطفال في النزاعات المسلحة .

🔹 On the occasion of the International Day Against the Recruitment of Children in Armed Conflicts, observed annually on February 12, and in line with the National Council for Liberties and Human Rights’ commitment to its human rights role, a roundtable discussion titled “Child Recruitment and Use in Armed Conflicts” was held this morning, Wednesday, at the Al-Mahari Hotel in Tripoli.
🔹 The session was chaired by the Council’s Advisor, Mr. Abdulbari Shenbaro, and the Director of the Women’s Affairs Department, Ms. Fatima Hawass. Attendees included Mr. Fahmy Al-Tawati, a member of the Human Rights Committee in the Libyan House of Representatives; Mr. Nouri Al-Waheishi, representing the Military Prosecution; Ms. Mariam Jafar, the Child Rights Officer at the United Nations Support Mission in Libya’s Human Rights Office; Ms. Tahmina Jangorian from the International Committee of the Red Cross; Mr. Omar Al-Askari from the International Organization for Migration; a representative from the United Nations Development Program; Dr. Wissam Omar Al-Majdoub from the Ministry of the Interior’s Human Rights Office; Ms. Mufida Al-Fetisi from the Ministry of Defense’s Human Rights and International Humanitarian Law Office; Ms. Naima Al-Maqoub from the High Committee for Childhood; Dr. Ali Abduljabbar, Coordinator of International Humanitarian Law at the Libyan Red Crescent Society; academic advisor Mr. Abdul Sayed Al-Isawi; Dr. Haider Al-Aib from the Libyan Association of Judicial Bodies; Mr. Ahmed Al-Zidani; and Mr. Khattab Khaled from the Center for International Humanitarian Law. Additionally, Dr. Huriya Derhoubi, Head of the Sociology Department at the University of Tripoli’s Faculty of Arts, participated. Many representatives of civil society organizations working in the fields of child rights and media also attended.
🔹 In his opening remarks, the Council emphasized its significant concern over the issue of child recruitment during armed conflicts, as it constitutes a violation of human rights and international humanitarian law. The Council called on all concerned parties, including official institutions, international organizations, and civil society, to take responsibility for protecting children from exploitation during conflicts. It urged legislative, judicial, and executive authorities to implement strict measures, enact appropriate legislation and policies, and ensure these age groups are not recruited. Furthermore, the Council called for raising public awareness about this humanitarian and human rights issue by including it among national priorities and institutional agendas.
🔹 The roundtable agenda covered several key topics, including: the position of international human rights law on child recruitment and participation in armed conflicts, other perspectives on the humanitarian aspects of international humanitarian law in combating child recruitment, the legal framework surrounding the phenomenon of child recruitment in armed conflicts, and the issue of age within Libyan legislation concerning child recruitment. Discussions also addressed the alignment of local laws with international agreements, particularly the discrepancies in defining childhood between civil law, child protection law, military law, and the penal code. The attendees exchanged opinions and insights on these matters.
🔹 The discussions were extensive, with participants expressing appreciation for the National Council for Liberties and Human Rights’ distinguished work in human rights management, especially in raising awareness, monitoring violations, receiving complaints, protecting victims of violations, and offering recommendations, particularly concerning the development of national legislation to align with the international human rights system.
🔹 At the conclusion of the roundtable, a set of important recommendations was made, emphasizing the national commitment to applying international humanitarian law and the international human rights framework, particularly the Convention on the Rights of the Child. Participants also stressed the need for continuous follow-up on the implementation of these recommendations, in accordance with institutional responsibilities, to reduce child recruitment in armed conflicts.
