في إطار ولايته القانونية واختصاصاته الوطنية في تعزيز وحماية حقوق الإنسان، وجّه المجلس الوطني للحريات العامة وحقوق الإنسان كتابًا رسميًا إلى معالي وزير الداخلية، بشأن تعزيز الضمانات الحقوقية في أماكن التوقيف والاحتجاز المؤقت المخصصة للنساء التابعة لمكونات وزارة الداخلية، وذلك في سياق تعزيز التعاون المؤسسي الرامي إلى الارتقاء بمنظومة العدالة الجنائية وترسيخ مبادئ سيادة القانون واحترام حقوق الإنسان.
وأكد المجلس في مراسلته تقديره للجهود التي تبذلها وزارة الداخلية في دعم الأمن والاستقرار، وتطوير أداء مؤسسات إنفاذ القانون، بما يعزز حماية المجتمع وصون الحقوق والحريات الأساسية، مشددًا على أهمية مواصلة التعاون المشترك لترسيخ المعايير الوطنية والدولية ذات الصلة بمعاملة الأشخاص المحرومين من حريتهم.
وأشار المجلس إلى أن متابعته المستمرة لأوضاع حقوق الإنسان، وما يرد إليه من شكاوى وبلاغات، إلى جانب أعمال الرصد والمتابعة التي يضطلع بها، تستدعي تعزيز الضمانات القانونية والحقوقية داخل أماكن التوقيف والاحتجاز المؤقت المخصصة للنساء، بما يكفل احترام الكرامة الإنسانية، ويحد من مخاطر التعرض لأي شكل من أشكال التعذيب أو سوء المعاملة أو المعاملة القاسية أو المهينة.
وأوضح المجلس أن مرحلة التوقيف أو الاحتجاز المؤقت، التي تسبق عرض المحتجزة على النيابة العامة أو السلطة القضائية المختصة، تُعد من أكثر مراحل الحرمان من الحرية حساسية، الأمر الذي يقتضي توفير بيئة احتجاز تراعي المعايير القانونية والحقوقية، وتضمن احترام حقوق المحتجزات وسلامتهن الجسدية والنفسية، وتكفل خضوع إجراءات الاحتجاز للرقابة القانونية الفاعلة.
كما أكد المجلس أن هذه المبادرة تستند إلى أحكام القانون رقم (5) لسنة 2011 بشأن إنشائه، وإلى مبادئ باريس المنظمة لعمل المؤسسات الوطنية لحقوق الإنسان، فضلًا عن التزامات دولة ليبيا بموجب الاتفاقيات الدولية والإقليمية ذات الصلة بحقوق الإنسان، والتي تفرض ضمان حماية جميع الأشخاص المحرومين من حريتهم دون تمييز، مع توفير الضمانات الكفيلة بصون كرامتهم الإنسانية.
واختتم المجلس مراسلته بالتأكيد على أهمية مواصلة التنسيق والتعاون مع وزارة الداخلية لتطوير السياسات والإجراءات المنظمة لأماكن التوقيف والاحتجاز المؤقت، وتعزيز برامج التدريب وبناء القدرات للعاملين بها، بما يسهم في تعزيز الثقة بمؤسسات إنفاذ القانون، وترسيخ مبادئ حقوق الإنسان، والارتقاء بمنظومة العدالة وسيادة القانون في دولة ليبيا.

Within the framework of its legal mandate and national responsibilities to promote and protect human rights, the National Council for Public Liberties and Human Rights has addressed an official letter to the Minister of Interior concerning the strengthening of human rights safeguards in temporary detention and custody facilities for women under the Ministry of Interior. This initiative forms part of the Council’s ongoing efforts to enhance institutional cooperation aimed at improving the criminal justice system, reinforcing the rule of law, and promoting respect for human rights.

In its correspondence, the Council expressed its appreciation for the efforts undertaken by the Ministry of Interior to promote security and stability and to strengthen the performance of law enforcement institutions in a manner that contributes to protecting society and safeguarding fundamental rights and freedoms. The Council emphasized the importance of continued cooperation to further consolidate national and international standards relating to the treatment of persons deprived of their liberty.

The Council noted that its continuous monitoring of the human rights situation, together with complaints and reports received, as well as its ongoing monitoring and documentation activities, underscore the need to reinforce legal and human rights safeguards within temporary detention facilities for women. Such measures are essential to ensuring respect for human dignity and reducing the risk of torture, ill-treatment, or cruel, inhuman, or degrading treatment or punishment.

The Council further highlighted that the period of temporary detention prior to a detainee’s appearance before the Public Prosecution or the competent judicial authority constitutes one of the most sensitive stages of deprivation of liberty. Accordingly, it stressed the necessity of ensuring detention conditions that comply with legal and human rights standards, protect the physical and psychological integrity of women detainees, and guarantee that detention procedures are subject to effective legal oversight.

The Council also affirmed that this initiative is based on the provisions of Law No. (5) of 2011 establishing the Council, the Paris Principles relating to the status of national human rights institutions, and Libya’s obligations under relevant international and regional human rights instruments. These obligations require the protection of all persons deprived of their liberty without discrimination and the provision of safeguards that uphold their inherent human dignity.

The Council concluded its letter by reaffirming the importance of continued coordination and cooperation with the Ministry of Interior to further develop policies and procedures governing temporary detention facilities, while strengthening training and capacity-building programmes for personnel working in these facilities. Such efforts, the Council noted, will contribute to enhancing public confidence in law enforcement institutions, promoting respect for human rights, and advancing the rule of law and the criminal justice system in the State of Libya.

في إطار تعزيز التعاون  وتبادل الخبرات بين المؤسسات الوطنية لحقوق الإنسان والآليات الوطنية الوقائية، أجرى وفد من المجلس الوطني للحريات وحقوق الإنسان بدولة ليبيا، برئاسة الاستاذ  عبد المولى رمضان أنتيشة القائم بأعمال المجلس، و الامين الإداري العام وعضوية عدد من مديري الإدارات، زيارة عمل إلى مقر الهيئة الوطنية للوقاية من التعذيب بالجمهورية التونسية بالعاصمة تونس يوم الجمعة الماضي .
وكان في استقبال الوفد بديوان الهيئة الدكتور فتحي الجراي، رئيس الهيئة الوطنية للوقاية من التعذيب ، وعلي هامش الزيارة عُقد اجتماع عمل تناول سبل تطوير التعاون المؤسسي وتبادل الخبرات والتجارب في المجالات ذات الاهتمام المشترك، بما يسهم في تعزيز الضمانات الوطنية للوقاية من التعذيب وسوء المعاملة، وترسيخ مبادئ احترام الكرامة الإنسانية وسيادة القانون.
وشهد اللقاء نقاشاً موسعاً حول أفضل الممارسات المتعلقة بتنفيذ الالتزامات الناشئة عن اتفاقية الأمم المتحدة لمناهضة التعذيب وبروتوكولها الاختياري، وآليات الرصد والزيارة الوقائية لأماكن الاحتجاز، وأهمية بناء القدرات المؤسسية، وتطوير أدوات التوثيق والرصد، وتعزيز التعاون مع السلطات المختصة والمجتمع المدني والشركاء الدوليين، بما ينسجم مع المعايير الدولية ذات الصلة.
كما استعرض الجانبان اختصاصات المؤسستين وتجربتيهما في حماية وتعزيز حقوق الإنسان، مؤكدين أهمية توطيد التعاون الفني وتبادل الخبرات والمعارف، بما يدعم تطوير السياسات والممارسات الوطنية الرامية إلى منع التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ويعزز من فعالية آليات الحماية والوقاية وفق المعايير الدولية.
وأكد المجلس الوطني للحريات وحقوق الإنسان أن هذه الزيارة تندرج ضمن توجهه الاستراتيجي نحو توسيع شراكاته مع المؤسسات الوطنية والآليات المستقلة المعنية بحقوق الإنسان في المنطقة العربية ، بما يعزز تبادل الخبرات، ويرسخ مبادئ التعاون الإقليمي، ويسهم في الارتقاء بالأداء المؤسسي وتطوير منظومة حماية حقوق الإنسان في ليبيا، اتساقاً مع مبادئ باريس والمعايير الدولية ذات الصلة.
وفي ختام الزيارة، أعرب وفد المجلس عن بالغ شكره وتقديره للدكتور فتحي الجراري ولجميع منتسبي الهيئة الوطنية للوقاية من التعذيب على حسن الاستقبال وكرم الضيافة، مثمناً الدور الرائد الذي تضطلع به الهيئة في تعزيز منظومة الوقاية من التعذيب وحماية الكرامة الإنسانية، ومؤكداً تطلعه إلى بناء شراكة مؤسسية مستدامة تسهم في دعم الجهود المشتركة الرامية إلى تعزيز وحماية حقوق الإنسان في البلدين الشقيقين.

As part of its efforts to strengthen cooperation and exchange expertise between National Human Rights Institutions (NHRIs) and National Preventive Mechanisms (NPMs), a delegation from the National Council for Public Liberties and Human Rights of the State of Libya, headed by Mr. Abdulmawla Ramadan Antisha, Acting President of the Council, accompanied by the Secretary-General for Administrative Affairs and a number of departmental directors, conducted a working visit to the headquarters of the National Authority for the Prevention of Torture of the Republic of Tunisia in Tunis last Friday.

The delegation was received by Dr. Fathi Jerari, President of the National Authority for the Prevention of Torture. During the visit, a bilateral working meeting was held to discuss avenues for enhancing institutional cooperation and exchanging expertise and best practices in areas of mutual interest. The discussions focused on strengthening national safeguards for the prevention of torture and ill-treatment, while promoting respect for human dignity and the rule of law.

The meeting featured an extensive exchange of views on best practices for implementing the obligations arising from the United Nations Convention against Torture (UNCAT) and its Optional Protocol (OPCAT). Discussions also addressed preventive monitoring and visits to places of deprivation of liberty, institutional capacity-building, the development of documentation and monitoring tools, and the importance of strengthening cooperation with competent national authorities, civil society organizations, and international partners, in line with relevant international human rights standards.

Both institutions also presented their respective mandates and experiences in the promotion and protection of human rights. They emphasized the importance of deepening technical cooperation and exchanging knowledge and expertise to support the development of national policies and practices aimed at preventing torture and other cruel, inhuman or degrading treatment or punishment, while enhancing the effectiveness of national protection and prevention mechanisms in accordance with international standards.

The National Council for Public Liberties and Human Rights affirmed that this visit forms part of its strategic vision to expand partnerships with national institutions and independent human rights mechanisms across the Arab region. Such cooperation is intended to promote the exchange of expertise, strengthen regional collaboration, enhance institutional performance, and contribute to the development of Libya’s human rights protection system in full accordance with the Paris Principles and other relevant international standards.

At the conclusion of the visit, the Council’s delegation expressed its sincere appreciation and gratitude to Dr. Fathi Jerari and all members of the National Authority for the Prevention of Torture for their warm welcome and generous hospitality. The delegation commended the Authority’s leading role in strengthening the national system for the prevention of torture and safeguarding human dignity, while expressing its aspiration to establish a sustainable institutional partnership that supports joint efforts to promote and protect human rights in the two brotherly countries.

اختتم المجلس الوطني للحريات وحقوق الإنسان أعمال ورشة العمل الخاصة باعتماد الدليل الوطني لإعداد التقارير الحقوقية (المراجعة والتدقيق والتطبيق العملي)، والتي استضافتها العاصمة التونسية على مدى خمسة أيام، بدعم فني من المؤسسة الألمانية للتعاون الدولي (GIZ)، وبتمويل من الاتحاد الأوروبي، في إطار جهود المجلس لتعزيز قدراته المؤسسية وتطوير منهجيات إعداد التقارير الحقوقية وفق المعايير الدولية.
وشهد حفل الاختتام حضور المكلف بتسيير أعمال المجلس الأستاذ عبدالمولي رمضان أبونتيشة، والمهندس راني داوود مدير برنامج دعم البلديات في ليبيا ومشروع «مساندة (2)» بالمؤسسة الألمانية للتعاون الدولي (GIZ)، والسيدة ميتا أو تشتريع مديرة مشروع «مساندة»، والأستاذ الصديق خالدي القائم بأعمال  الهيئة العليا لحقوق الإنسان بالجمهورية التونسية، إلى جانب عدد من الخبراء والمختصين ، كما شارك في أعمال الورشة الأمين الإداري العام للمجلس الأستاذ محمد المكشر، وممثلون عن إدارات ديوان و مناطقه  من مختلف المناطق الليبية.
وأكد المتحدثون خلال الجلسة الختامية أن اعتماد الدليل يمثل خطوة مؤسسية نوعية نحو توحيد منهجيات الرصد والتوثيق وإعداد التقارير داخل المجلس، بما يعزز جودة المخرجات الحقوقية، ويرسخ الممارسات المهنية المتوافقة مع المعايير الدولية ومبادئ باريس المنظمة لعمل المؤسسات الوطنية لحقوق الإنسان.
كما تضمنت الجلسة الختامية عروضًا استعرضت جهود المجلس في إعداد واعتماد حزمة من الأدلة الإجرائية، وخططه لرقمنتها وميكنة إجراءات العمل المؤسسي، إضافة إلى عرض ملامح الدليل التكاملي الذي يعتزم المجلس تطويره خلال المرحلة المقبلة.
واختُتمت الورشة باعتماد الصيغة النهائية للدليل الوطني لإعداد التقارير الحقوقية، ليكون مرجعًا مؤسسيًا موحدًا يسهم في تطوير جودة التقارير الحقوقية، ورفع كفاءة الكوادر الوطنية في مجالات الرصد والتوثيق وإعداد التقارير، بما يعزز ولاية المجلس في حماية وتعزيز حقوق الإنسان ومتابعة تنفيذ الالتزامات الوطنية والدولية ذات الصلة.

The National Council for Public Liberties and Human Rights concluded a five-day workshop dedicated to the validation of the National Guide for Human Rights Reporting (Review, Validation, and Practical Application), held in Tunis with technical support from the German Agency for International Cooperation (GIZ) and funding from the European Union. The workshop formed part of the Council’s ongoing efforts to strengthen its institutional capacity and enhance human rights reporting methodologies in line with international standards.

The closing ceremony was attended by Mr. Abdulmoula Ramadan Abunteisha, Acting Head of the National Council for Public Liberties and Human Rights; Mr. Rani Daoud, Programme Manager for the Municipal Support Programme in Libya and the Musanada II Project at GIZ; Ms. Meta O. Tschtrieg, Project Manager of the Musanada Project; and Mr. Sadok Khaldi, Acting Head of the Higher Committee for Human Rights of the Republic of Tunisia. The event also brought together a number of experts and specialists. The workshop was attended by the Council’s Administrative Secretary-General, Mr. Mohammed Al-Mukashar, along with representatives from the Council’s departments and regional offices across Libya.

During the closing session, speakers emphasized that the adoption of the Guide represents a significant institutional milestone toward standardizing methodologies for monitoring, documentation, and human rights reporting within the Council. They noted that the Guide will contribute to improving the quality of human rights reporting while promoting professional practices consistent with international standards and the Paris Principles governing National Human Rights Institutions.

The closing session also featured presentations highlighting the Council’s efforts to develop and adopt a comprehensive set of procedural manuals, as well as its plans to digitalize these resources and automate institutional workflows. Participants were also introduced to the key features of an integrated institutional guide that the Council intends to develop during the next phase.

The workshop concluded with the formal adoption of the final version of the National Guide for Human Rights Reporting, which will serve as a unified institutional reference to enhance the quality of human rights reports and strengthen the capacities of national staff in monitoring, documentation, and reporting. The Guide will further support the Council in fulfilling its mandate to protect and promote human rights and to monitor the implementation of Libya’s national and international human rights obligations.

At the conclusion of the workshop, certificates of participation were awarded to all participants. The Council also expressed its sincere appreciation to GIZ and the European Union for their valuable support and reaffirmed its commitment to strengthening partnerships with national and international institutions in order to enhance institutional performance and further advance the human rights system in Libya.

وأوضح المجلس أن المفوضية السامية أكدت على الدور المحوري للمؤسسات الوطنية لحقوق الإنسان في متابعة ورصد تنفيذ توصيات آليات الأمم المتحدة، وتقييم مدى امتثال الحكومات لالتزاماتها الدولية، وإعداد التقارير المستقلة بشأن مستوى التنفيذ، بما ينسجم مع مبادئ باريس المنظمة لعمل المؤسسات الوطنية لحقوق الإنسان.
وأكد المجلس أن ولايته القانونية تقتصر على ممارسة دوره الرقابي والاستشاري، من خلال رصد أداء الجهات التنفيذية وتقييم مدى التزامها بتنفيذ تعهداتها الدولية في مجال حقوق الإنسان، وتقديم التوصيات والتقارير المستقلة، دون أن يحل محل السلطات التنفيذية أو يباشر اختصاصاتها.
وانطلاقًا من هذا الدور الرقابي، أوصى المجلس رئيس حكومة الوحدة الوطنية باتخاذ الإجراءات اللازمة لإصدار قرار بإنشاء اللجنة الوطنية الدائمة لمتابعة تنفيذ توصيات الاستعراض الدوري الشامل والالتزامات الدولية في مجال حقوق الإنسان، بما يعزز التنسيق المؤسسي، ويرفع كفاءة تنفيذ التوصيات، ويدعم وفاء دولة ليبيا بالتزاماتها الدولية.

Within the framework of its legal mandate to promote and protect human rights, the National Council for Freedoms and Human Rights has sent an official letter to the Prime Minister of the Government of National Unity in response to a referral and mandate from the Office of the United Nations High Commissioner for Human Rights (OHCHR) concerning the follow-up to the outcomes of Libya’s Universal Periodic Review (UPR), which were adopted by the Human Rights Council at its 61st session.

The Council explained that the OHCHR emphasized the pivotal role of National Human Rights Institutions (NHRIs) in monitoring and following up on the implementation of recommendations issued by United Nations human rights mechanisms, assessing governments’ compliance with their international human rights obligations, and preparing independent reports on the level of implementation, in accordance with the Paris Principles governing the work of National Human Rights Institutions.

The Council further stressed that its legal mandate is limited to its oversight and advisory functions, which include monitoring the performance of executive authorities, evaluating their compliance with international human rights commitments, and issuing independent recommendations and reports. It underscored that it does not replace executive authorities or exercise their powers.

In line with this oversight role, the Council recommended that the Prime Minister of the Government of National Unity take the necessary measures to issue a decision establishing a Permanent National Committee to oversee the implementation of the Universal Periodic Review recommendations and Libya’s international human rights obligations. The proposed committee would strengthen institutional coordination, enhance the effectiveness of implementing the recommendations, and support Libya’s fulfillment of its international commitments in the field of human rights.

National Council for Freedoms and Human Rights Launches Final Phase for the Adoption of the National Guide to Human Rights Reporting, with Technical Support from GIZ and Funding from the European Union

The National Council for Freedoms and Human Rights has launched the final workshop for the adoption of the National Guide to Human Rights Reporting (Review, Validation, and Practical Application) in the Tunisian capital on Monday morning. The workshop is organized with technical support from the German Agency for International Cooperation (GIZ) and funding from the European Union.

The four-day workshop brings together representatives from the Council’s branches and departments across Libya’s eastern, western, southern, and central regions, in addition to a representative from the Ministry of Interior.

The workshop is part of the Council’s ongoing efforts to strengthen and modernize the national human rights reporting system by enhancing its efficiency in line with national and international standards and best practices. It aims to adopt the National Guide to Human Rights Reporting as a unified national reference that establishes the procedural, methodological, and technical framework for preparing human rights reports.

The workshop seeks to conduct a comprehensive and participatory review of the Guide, validate its content, and assess its practical applicability. The outcomes will contribute to refining and improving the Guide before its final adoption, ultimately establishing a unified national methodology that enhances the quality and consistency of the Council’s human rights reports.

Throughout the workshop, participants will review and validate the Guide’s procedural, methodological, and technical components, consolidate comments and recommendations on each section, and carry out practical exercises on preparing human rights reports in accordance with the Guide’s methodology. These activities are designed to strengthen participants’ capacity to apply the Guide effectively in fieldwork and produce reports based on scientific and professional standards.

The workshop follows a participatory approach, with participants divided into three working groups to review the Guide’s chapters using standardized templates for documenting observations and recommendations. The findings of each group will be presented and discussed at the end of each day, with agreed recommendations subsequently submitted to the drafting team for consideration and incorporation into the final version of the Guide.

This workshop reflects the National Council for Freedoms and Human Rights’ continued commitment to strengthening its institutional tools, improving the quality of human rights reporting, and establishing a unified national methodology consistent with the Paris Principles and international human rights standards. The National Council for Public Liberties and Human Rights has addressed an official memorandum to the Chairperson of the Board of Directors of the General Electricity Company, outlining the human rights obligations associated with ensuring the uninterrupted provision of electricity services. The memorandum emphasizes that electricity is an essential public service intrinsically linked to a range of rights guaranteed under national legislation and international human rights instruments, foremost among them the rights to life, health, water, education, work, and an adequate standard of living.

The Council affirmed that the provision of electricity should not be regarded merely as a service delivery or administrative responsibility, but rather as a legal and human rights obligation incumbent upon the State and its institutions, in accordance with national laws and relevant international human rights standards. This obligation requires ensuring the continuity of essential public services while safeguarding human dignity.

The Council further noted that recurring power outages have a direct impact on the enjoyment of fundamental human rights, adversely affecting the functioning of vital public facilities, particularly healthcare, educational, and other essential service institutions. It also highlighted the broader social, economic, and humanitarian consequences of these disruptions, stressing the need for urgent and effective measures to address the underlying causes of the electricity crisis and mitigate its impacts.

The Council called for the adoption of a human rights-based approach to the governance of the electricity sector, founded on the principles of equality and non-discrimination, transparency, accountability, and prioritizing the protection of the most vulnerable groups. Such an approach, the Council emphasized, would contribute to the sustainability of electricity services and strengthen public confidence in State institutions.

The Council also reaffirmed its readiness to cooperate with the competent authorities in supporting efforts aimed at improving public services, in line with its national mandate to promote and protect human rights, and in a manner that ensures respect for fundamental rights and the preservation of human dignity.

استقبل المجلس الوطني للحريات وحقوق الإنسان، ظهر اليوم الأربعاء، بمقره في العاصمة طرابلس، السيد ماركو كولبوش، مسؤول حقوق الإنسان وسيادة القانون والعدالة الأنتقالية ببعثة الأمم المتحدة للدعم في ليبيا، يرافقه السيدة مريم جعفر، مسؤولة حقوق الإنسان بالبعثة، وذلك في إطار تعزيز التعاون المؤسسي والتنسيق المشترك في مجالات حماية وتعزيز حقوق الإنسان، ودعم سيادة القانون، وبحث أولويات العمل الحقوقي في ليبيا.
وعقد الوفد اجتماعًا مع رئيس المجلس الوطني للحريات وحقوق الإنسان، الأستاذ عبدالمولى أبونتيشة، بحضور مدير إدارة التعاون الدولي، الأستاذ سالم الطيب، ومدير إدارة الشكاوى ورصد الانتهاكات، الأستاذة فاطمة عمر حواص.
وتناول الاجتماع ولاية المجلس واختصاصاته بوصفه المؤسسة الوطنية المعنية بتعزيز وحماية حقوق الإنسان، وآليات اضطلاعه بمهامه في مجالات الرصد والتوثيق، واستقبال الشكاوى، ورصد أوضاع حقوق الإنسان، إلى جانب دوره في إعداد التقارير الوطنية وإصدار التوصيات ومتابعة تنفيذها، بما يسهم في تعزيز احترام حقوق الإنسان وترسيخ مبادئ سيادة القانون.
وقدمت رئاسة المجلس عرضًا شاملًا حول أولوياته الاستراتيجية وبرامج عمله، مستعرضةً منهجية المجلس في توثيق انتهاكات حقوق الإنسان وفق المعايير المهنية المعتمدة، وآليات معالجة الشكاوى، والإجراءات المتبعة في الرصد والتحقق وإعداد التقارير الموضوعية المستندة إلى الأدلة، بما يعزز المساءلة ويخدم جهود حماية الحقوق والحريات الأساسية بليبيا .
كما استعرض المجلس جهوده في دعم تطوير المنظومة التشريعية الوطنية بما يعزز مواءمتها مع الاتفاقيات الدولية لحقوق الإنسان والتزامات الدولة الليبية، مستعرضًا عددًا من المبادرات التشريعية التي يعمل عليها، وفي مقدمتها مشروع قانون حماية البيانات الشخصية ، ومشروع قانون مكافحة الاتجار بالأشخاص، ومشروع قانون حقوق الأشخاص ذوي الإعاقة، باعتبارها تشريعات تسهم في تعزيز حماية الحقوق والحريات الأساسية وترسيخ الضمانات القانونية للفئات المستحقة للحماية.
وتناول الاجتماع كذلك المؤشرات والبيانات التي رصدها المجلس بشأن حالات الحرمان التعسفي من الحق في الحياة والقتل خارج نطاق القانون خلال النصف الأول من عام 2026، حيث قدم المجلس عرضًا لأبرز النتائج التي توصل إليها من خلال أعمال الرصد والتوثيق، مؤكدًا ضرورة إجراء تحقيقات مستقلة وفعالة، وضمان المساءلة وعدم الإفلات من العقاب، بما يتوافق مع الالتزامات القانونية الوطنية والمعايير الدولية لحقوق الإنسان.
كما استعرض المجلس نتائج زياراته الميدانية إلى مؤسسات الإصلاح والتأهيل، وما تضمنته تقاريره من ملاحظات وتوصيات تتعلق بتحسين أوضاع الاحتجاز وضمان معاملة الأشخاص المحرومين من حريتهم بما يتوافق مع المعايير الدولية، وبما يحفظ كرامتهم الإنسانية ويكفل احترام حقوقهم الأساسية.
وفي السياق ذاته، ناقش الاجتماع نتائج الزيارات الميدانية التي أجراها المجلس إلى مراكز إيواء المهاجرين، وما خلصت إليه من ملاحظات وتوصيات بشأن أوضاع المهاجرين، مع التأكيد على أهمية احترام حقوقهم الإنسانية، وتعزيز التدابير الكفيلة بحمايتهم، وضمان المعاملة الإنسانية دون تمييز، انسجامًا مع المعايير الدولية ذات الصلة.
كما استعرض المجلس علاقاته مع الشركاء الدوليين، والبرامج والمشروعات التي ينفذها بدعم فني وتقني في مجالات بناء القدرات والتطوير المؤسسي، إلى جانب عرض أبرز أولوياته واحتياجاته المؤسسية، وفي مقدمتها تعزيز القدرات الفنية والمؤسسية، وتطوير نظم الرصد والتوثيق وإدارة الشكاوى، ودعم إعداد الدراسات والتقارير، بما يمكن المجلس من الاضطلاع بولايته الوطنية بكفاءة واستقلالية وفاعلية.
من جانبه، أشاد وفد بعثة الأمم المتحدة للدعم في ليبيا بالدور الذي يضطلع به المجلس في تعزيز وحماية حقوق الإنسان، مؤكدًا أهمية استمرار التعاون والتنسيق مع المؤسسة الوطنية لحقوق الإنسان، ودعم جهودها الرامية إلى تعزيز سيادة القانون، وترسيخ مبادئ المساءلة، والوفاء بالتزامات ليبيا الدولية في مجال حقوق الإنسان.
واختُتم اللقاء بالتأكيد على أهمية مواصلة الحوار والتعاون بين المجلس الوطني للحريات العامة وحقوق الإنسان وبعثة الأمم المتحدة للدعم في ليبيا، بما يسهم في دعم الجهود الوطنية الرامية إلى تعزيز منظومة حقوق الإنسان، وترسيخ مبادئ سيادة القانون، وبناء مؤسسات وطنية أكثر قدرة على حماية الحقوق والحريات وتعزيز احترامها وفقًا للمعايير الدولية.

The National Council for Public Liberties and Human Rights received, on Wednesday afternoon at its headquarters in Tripoli, Mr. Marco Kolbush, Human Rights, Rule of Law and Transitional Justice Officer at the United Nations Support Mission in Libya (UNSMIL), accompanied by Ms. Mariam Jaafar, Human Rights Officer at the Mission. The visit took place within the framework of strengthening institutional cooperation and joint coordination in the fields of the promotion and protection of human rights, support for the rule of law, and the discussion of key human rights priorities in Libya.

The UNSMIL delegation held a meeting with the President of the National Council for Public Liberties and Human Rights, Mr. Abdulmawla Abunteisha, in the presence of Mr. Salem Al-Tayeb, Director of the International Cooperation Department, and Ms. Fatima Omar Hawwas, Director of the Complaints and Violations Monitoring Department.

The meeting addressed the Council’s mandate and competencies as Libya’s national institution responsible for the promotion and protection of human rights, as well as the mechanisms through which it carries out its functions in monitoring and documenting human rights violations, receiving and processing complaints, assessing the human rights situation, preparing national reports, issuing recommendations, and following up on their implementation, thereby contributing to the promotion of respect for human rights and the strengthening of the rule of law.

The Council’s Presidency delivered a comprehensive presentation outlining its strategic priorities and programmes of work, highlighting the Council’s methodology for documenting human rights violations in accordance with internationally recognized professional standards. The presentation also covered the Council’s complaints-handling mechanisms and its procedures for monitoring, verification, and the preparation of objective, evidence-based reports aimed at strengthening accountability and advancing the protection of fundamental rights and freedoms in Libya.

The Council further presented its efforts to support the development of Libya’s national legislative framework in line with international human rights treaties and the State’s international obligations. It highlighted a number of legislative initiatives currently under development, including a Draft Personal Data Protection Law, a Draft Anti-Trafficking in Persons Law, and a Draft Law on the Rights of Persons with Disabilities, all of which are intended to strengthen the protection of fundamental rights and freedoms and reinforce legal safeguards for groups requiring special protection.

The meeting also reviewed the Council’s findings and data concerning cases of arbitrary deprivation of the right to life and extrajudicial killings documented during the first half of 2026. The Council presented its principal findings based on its monitoring and documentation activities, emphasizing the necessity of conducting prompt, independent, and effective investigations, ensuring accountability, and combating impunity in accordance with Libya’s national legal obligations and international human rights standards.

In addition, the Council presented the outcomes of its field visits to correctional and rehabilitation institutions, together with the observations and recommendations contained in its reports regarding the improvement of detention conditions and the need to ensure that persons deprived of their liberty are treated in accordance with international standards, in a manner that preserves their human dignity and guarantees respect for their fundamental rights.

The meeting also addressed the findings of the Council’s field visits to migrant accommodation and detention centres, including the observations and recommendations concerning the situation of migrants. Particular emphasis was placed on the importance of safeguarding their human rights, strengthening protection measures, and ensuring humane treatment without discrimination, in line with applicable international standards.

Furthermore, the Council reviewed its cooperation with international partners and the programmes and projects implemented with technical and institutional support in the areas of capacity-building and institutional development. It also outlined its key institutional priorities and needs, including strengthening technical and institutional capacities, enhancing monitoring, documentation and complaints management systems, and supporting the preparation of studies and reports, thereby enabling the Council to effectively, independently, and efficiently fulfil its national mandate.

For its part, the UNSMIL delegation commended the Council’s important role in promoting and protecting human rights and underscored the importance of maintaining close cooperation and coordination with Libya’s National Human Rights Institution. The delegation reaffirmed its support for the Council’s efforts to strengthen the rule of law, promote accountability, and assist Libya in fulfilling its international human rights obligations.

The meeting concluded with both sides reaffirming the importance of continuing dialogue and cooperation between the National Council for Public Liberties and Human Rights and the United Nations Support Mission in Libya. Such cooperation will contribute to supporting national efforts aimed at strengthening the human rights framework, consolidating the rule of law, and building stronger national institutions capable of protecting and promoting human rights and fundamental freedoms in accordance with international standards.

احتضنت مدينة بنغازي، صباح اليوم السبت، أعمال الورشة الوطنية لمناقشة نتائج الدورة الرابعة لآلية الاستعراض الدوري الشامل لحقوق الإنسان (UPR)، والمخصصة لاستعراض التقرير المعتمد بشأن ليبيا (الوثيقة A/HRC/61/17)، وذلك بمقر الهلال الأحمر الليبي، بمشاركة واسعة من ممثلي الجهات الحكومية، والمؤسسات الوطنية، والخبراء القانونيين والحقوقيين، إلى جانب عدد من الخبراء الدوليين ومنظمات المجتمع المدني ، وتأتي هذه الورشة في إطار دعم الجهود الوطنية الرامية إلى متابعة تنفيذ التوصيات الصادرة عن مجلس حقوق الإنسان، وتعزيز مواءمة التشريعات والسياسات الوطنية مع التزامات ليبيا الدولية في مجال حقوق الإنسان، بما يرسخ مبادئ الحوكمة الرشيدة وسيادة القانون.
واستُهلت أعمال الورشة بكلمة ألقتها السيدة نعيمة بالقاسم العريبي، نائب رئيس المجلس الوطني للحريات وحقوق الإنسان، رحبت فيها بالمشاركين، مؤكدة أن آلية الاستعراض الدوري الشامل تمثل إحدى أهم الآليات الأممية القائمة على الحوار والتعاون بين الدول، وتشكل فرصة وطنية لتقييم التقدم المحرز في مجال حماية وتعزيز حقوق الإنسان، وتطوير السياسات العامة على أساس التوصيات المقبولة وأفضل الممارسات الدولية.
من جانبه، أكد معالي وزير الخارجية والتعاون الدولي بالحكومة الليبية، الدكتور عبد الهادي الحويج، في كلمته الافتتاحية، أن مسار الاستعراض الدوري الشامل لا ينبغي النظر إليه باعتباره مجرد التزام دولي، بل يمثل مساراً وطنياً وسيادياً يهدف إلى تطوير منظومة حقوق الإنسان وتعزيز أداء مؤسسات الدولة. وشدد على أهمية توحيد الجهود الوطنية، واعتماد آلية مؤسسية دائمة وخطة استراتيجية واضحة لمتابعة تنفيذ التوصيات، بما يكفل إعداد تقارير وطنية تستند إلى مؤشرات موضوعية وتعكس بصورة دقيقة ما تحقق من تقدم في الوفاء بالالتزامات الدولية، مؤكداً أن تعزيز حقوق الإنسان يمثل أحد المرتكزات الأساسية للدبلوماسية الليبية.
وعقب الجلسة الافتتاحية، ترأس المستشار إدريس علي الغزالي الجلسات الفنية للورشة، حيث قدم الأستاذ داود العقوري عرضاً تعريفياً حول المجلس الوطني للحريات وحقوق الإنسان، استعرض خلاله الإطار القانوني المنظم لعمل المجلس واختصاصاته ودوره في تعزيز وحماية حقوق الإنسان، وفقاً للمعايير الوطنية والدولية ذات الصلة.
كما تضمنت أعمال الورشة عدداً من العروض التخصصية التي قدمها خبراء وطنيون ودوليون، تناولت الإطار المفاهيمي والقانوني لآلية الاستعراض الدوري الشامل، وقراءة تحليلية للتوصيات الموجهة إلى ليبيا خلال الدورة الرابعة، مع استعراض أفضل الممارسات المتعلقة بمتابعة تنفيذ التوصيات، وآليات إعداد التقارير الوطنية، وتعزيز مشاركة المؤسسات الوطنية والمجتمع المدني في هذه العملية.
وشهدت الورشة جلسة نقاشية موسعة، أدارها الأستاذ إدريس علي الغزالي، بمشاركة ممثلي الوزارات والجهات الحكومية ذات العلاقة، والخبراء القانونيين، ومؤسسات المجتمع المدني، حيث جرى تبادل الرؤى حول الأولويات الوطنية لتنفيذ التوصيات، والتحديات القائمة، والسبل الكفيلة بتعزيز التنسيق المؤسسي، بما يسهم في بناء إطار وطني متكامل لمتابعة تنفيذ مخرجات الاستعراض الدوري الشامل.

Benghazi Hosts National Workshop to Discuss the Outcomes of the Universal Periodic Review: Reaffirming Libya’s National Commitment to Human Rights and International Obligations

The city of Benghazi hosted, on Saturday morning, a national workshop dedicated to discussing the outcomes of the fourth cycle of the Universal Periodic Review (UPR) of Human Rights, focusing on the adopted report on Libya (Document A/HRC/61/17). The workshop was held at the headquarters of the Libyan Red Crescent and brought together a broad range of participants, including representatives of government institutions, national bodies, legal and human rights experts, international specialists, and civil society organizations.

The workshop was organized as part of ongoing national efforts to follow up on the implementation of the recommendations issued by the Human Rights Council and to strengthen the alignment of Libya’s legislation and public policies with its international human rights obligations, thereby reinforcing the principles of good governance and the rule of law.

The event commenced with opening remarks delivered by Ms. Naima Belqasem Al-Aribi, Deputy Chairperson of the National Council for Liberties and Human Rights, who welcomed the participants and emphasized that the Universal Periodic Review is one of the United Nations’ most significant mechanisms based on dialogue and cooperation among States. She described it as an important national opportunity to assess progress in the protection and promotion of human rights and to improve public policies in light of accepted recommendations and international best practices.

In his keynote address, H.E. Dr. Abdulhadi Al-Hwaij, Minister of Foreign Affairs and International Cooperation of the Libyan Government, stressed that the Universal Periodic Review should not be viewed merely as an international obligation, but rather as a national and sovereign process aimed at strengthening Libya’s human rights framework and enhancing the performance of State institutions. He underscored the importance of consolidating national efforts through the establishment of a permanent institutional mechanism and a clear strategic plan for implementing the UPR recommendations. Such an approach, he noted, would ensure the preparation of national reports based on objective indicators and accurately reflect Libya’s progress in fulfilling its international commitments. He further affirmed that the promotion of human rights constitutes one of the fundamental pillars of Libyan diplomacy.

Following the opening session, the technical sessions were chaired by Counsellor Idris Ali Al-Ghazali. During these sessions, Mr. Dawood Al-Agouri delivered a presentation introducing the National Council for Liberties and Human Rights, outlining its legal mandate, institutional framework, competencies, and role in promoting and protecting human rights in accordance with relevant national legislation and international standards.

The workshop also featured a series of specialized presentations delivered by national and international experts, covering the conceptual and legal framework of the Universal Periodic Review mechanism, an analytical review of the recommendations addressed to Libya during the fourth UPR cycle, best practices for monitoring implementation, national reporting procedures, and mechanisms for enhancing the participation of national institutions and civil society organizations throughout the implementation process.

A comprehensive panel discussion, moderated by Mr. Idris Ali Al-Ghazali, brought together representatives of relevant ministries and government agencies, legal experts, and civil society organizations. Participants exchanged views on national priorities for implementing the recommendations, the challenges facing the process, and practical approaches to strengthening institutional coordination in order to establish an integrated national framework for monitoring the implementation of the UPR outcomes.

The workshop concluded with a set of recommendations emphasizing the importance of developing a comprehensive national implementation plan for the accepted recommendations, enhancing coordination among national institutions, and strengthening monitoring, follow-up, and evaluation mechanisms to ensure the sustainability of national efforts in promoting and protecting human rights and to reinforce Libya’s compliance with its international obligations before the Human Rights Council.

The workshop reflects the commitment of Libya’s national institutions to promoting constructive institutional dialogue and cooperation with national and international partners. It also reaffirms that respect for human rights and the rule of law constitutes a fundamental pillar for achieving sustainable development and consolidating a State founded on the principles of justice, the rule of law, and strong institutions.
